Canada's government is committed to protecting and promoting the rights of LGBTQ+ individuals. They ensure that members of this community have equal rights and opportunities compared to others when it comes to immigration matters.
The path to immigrating to Canada as an LGBTQ+ person may vary deping on your circumstances, but there are several routes you could consider:
1 Skilled Worker Programs
For those with specialized skills or work experience, the federal government offers various skilled worker programs. A widely sought-after option is the Federal Skilled Worker Program FSWP, which targets individuals who can contribute economically to Canada and have job-related skills that match in-demand sectors.
Canadian provinces often have their own versions of this program known as Provincial Nominee Programs PNPs. These m at inviting foreign workers with specific skills that are needed within the province. The criteria for eligibility might vary slightly from one province to another but generally, they consider aspects like work experience, language proficiency, education level, and adaptability.
As a queer individual who successfully immigrates through these programs will be able to enhance Canada's workforce by leveraging their professional expertise as permanent residents. These skilled worker pathways are open regardless of ger identity or sexual orientation.
Many people who eventually become skilled immigrants in Canada start with a temporary work permit or as international students.
2 Spousal Sponsorship
Same-sex partners have been eligible for sponsorship through family class programs since 2002. An LGBTQ+ Canadian citizen or permanent resident can sponsor their legally married spouse, common-law partner, or conjugal partner based on the requirement that they are in a genuine and valid relationship.
The application process necessitates:
1 The sponsoring individual must agree to support their partner financially.
2 Evidence of both partners being in relationship is needed as per IRCC's definition for a common-law or conjugal partner.
LGBTQ+ individuals have equal opportunities for spousal sponsorship compared to other applicants.
3 Refugee Resettlement
Canada upholds the rights and safety of vulnerable foreign nationals, including members of the LGBTQ+ community. If returning home would expose an individual to persecution due to ger identity, sexual orientation, or ger expression, they may seek refugee status or asylum in Canada with support from organizations like UNHCR United Nations High Commissioner for Refugees and private sponsors.
Recent Developments
To better align with international standards of rights protection, the Immigration and Refugee Board IRB of Canada introduced updated guidelines in May 2017 to improve how refugee clmants are evaluated based on sexual orientation, ger identity, and ger expression. This initiative enhance IRB staff trning to sensitively question individuals about these sensitive topics and provide a more compassionate evaluation process.
In August 2017, Canada took another step towards inclusivity by allowing Canadian citizens to apply for passports with an unspecified 'X' ger designation on them, rather than just male or female. The government is working on implementing this inclusive policy across all immigration processes and departments to ensure equitable access.
