Changes in the Canadian Temporary Foreign Worker Program
In an announcement effective January 1st, 2024, Employment and Social Development Canada ESDC introduced significant refor the Temporary Foreign Worker Program TFWP. These changes m to ensure fr wages for foreign workers while addressing labor shortages in specific sectors.
Annual Wage Review Requirement
Starting next year, employers will be required to conduct an annual review of wage rates based on their Labour Market Impact Assessment LMIA-based foreign worker employees. This new requirement aligns with any updates ESDC makes to prevling wage rates on their Job Bank website. Employers will need to complete this review by January 1st following the November wage update.
Other Key TFWP Changes
ESDC has outlined several other significant adjustments:
LMIA Approval Validity: The validity of an LMIA approval is now reduced from 18 months to 12 months.
Hiring Limits for Low-Wage Positions: Employers are permitted to hire up to 30 of their workforce through the TFWP in sectors experiencing labor shortages until August 30, 2024.
Duration of Employment for Low-Wage Workers: Employment under LMIA approval for low-wage positions is limited to two years until August 30, 2024.
Agricultural Stream LMIA Employers' Policy
A temporary public policy that wved recruitment requirements for Agricultural Stream LMIA employers will on June 30, 2024. New applications under this stream will need to adhere to recruitment requirements from then onwards.
ESDC's Continuous Review of Policies
As Canada’s labor market evolves, ESDC anticipates reviewing policies to ensure they meet the current economic conditions and labor needs. Regular updates will be provided for employers' guidance.
